General Terms and Conditions (GTC)

 

Information

Marketing Monkeys GmbH is the operator of www.marketingmonkeys.ch and owner of the protected Marketing Monkeys brand.

 

1. General Remarks

The place of jurisdiction or applicable law in the event of any disputes shall be the court in Solothurn (Switzerland). Swiss law shall apply.

Marketing Monkeys GmbH is represented by Mr. Thomas Roth and Ms. Carolina Glauninger.

 

2. Compensation

Our services are logged and billed according to hours actually worked. The following services are recorded in Jira project management software:

  • Time for service, development and consulting (telephone, personal, in writing)
  • Preparation times and post-processing times
  • Meetings, Seminars and Workshops


Times for updates, maintenance or hosting are not included. Those are stipulated in a specific service level agreement with the client. All information is subject to change. Errors and misprints excepted.

 

3. Expenses

Travel costs are charged at 0.70 Swiss Francs per kilometer. Alternatively: Public transport will be charged at "Halbtax" 1st class rate. Lunch is charged at a flat rate of CHF 30, dinner at CHF 40.

 

4. Payment

For orders exceeding the quoted amount of CHF 5,000.-, the services will be billed monthly according to the time reports. After signing the order confirmation, the provision of services will begin and the agreed invoice amount will be due within 20 days. Contract cancellation is no longer possible. Service-Level Agreements and license fees for websites, software tools, etc., are billed in advance. In the event of late payment, reminder fees of CHF 50.- per reminder will be charged from the first reminder level. If payment is overdue by more than 60 days, late fees of 7% (annual interest) of the invoiced amount will be charged from the first overdue day. We reserve the right to revoke the payment option "on account.

5. Rights of Use

The redistribution of Monkey models, theories, software and other proprietary items is only permitted by written consent. The making of copies for the purpose of sale, commercial lending, public broadcasting or passing on or transfer to third parties will be sanctioned without exception.

All agreed and stipulated rights of use under a mutual contract, are only transferred to customers, as soon as no claims are outstanding. 

 

6. Data Policy

Marketing Monkeys GmbH informs with the privacy policy about the processing of personal data and the rights of data subjects.
If and to the extent that commissioned processing takes place, the commissioned processing agreement shall be deemed to be an integral part of these GTC.   

 

7. Software

Account blocking

Developed individual software and Automation Monkey licenses as well as SLAs will be deactivated 14 days after reaching the first invoice reminder stage. The Automation Monkey account will be automatically locked until full payment is received. From this point on, a payment period of 20 days applies, before the account is automatically deleted. All customer data will be completely removed at this time. A one-off fee of CHF 600.- will be charged for reactivation and recovery of the account.
